TERMS & CONDITIONS

These Terms and Conditions apply to all patients, clients, customers, and users of Pliabl Ltd, and are the Terms and Conditions governing the use of Pliabl Ltd.’s services. These Terms and Conditions set out the rights and obligations of all users regarding the sale and use of all products and services provided by Pliabl.

1          Acceptance of Terms

By accessing or using the products and services provided by Pliabl Ltd (“Pliabl”, “the Company”, “our”, “we” or “us”), you agree to comply with and be bound by the following Terms and Conditions. If you do not agree to these terms, please do not use our services, our website or our social media channels.

2          Entire Agreement

These Terms and Conditions shall be read together with any relevant Membership or Service Agreement and embodies the entire agreement between you and Pliabl and supersedes any prior negotiation, conduct, arrangement, understanding or agreement, express or implied, in relation to the subject matter of this agreement.

3          Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. We will notify you of any changes by posting the new Terms & Conditions on our website. It is your responsibility to review these terms periodically for changes. Continued use of our services after any modifications shall constitute your consent to such changes.

4          Behavioural Guidelines

At Pliabl we are committed to providing a safe, respectful, and comfortable environment for our team and all our clients. To ensure this, we ask all our team members and clients to adhere to our behavioural guidelines:

  • Respect and Courtesy: Please treat all team members and fellow patients with respect and courtesy. We have a zero tolerance to any form of disrespectful behaviour, including but not limited to offensive language, discrimination, harassment, or bullying.
  • Professional Boundaries: Our team is here to provide you with a professional service. Services of sexual, or otherwise inappropriate, nature will never be offered, provided, or tolerated.
  • Safety: For the safety of our team and our clients, we have zero tolerance to any form of threat or violence, including but not limited to physical violence, verbal threats, offensive language, discrimination, harassment, or bullying.
  • Service compliance: Please adhere with any instructions provided by our team related to your treatment or clinic policies.

Failure to comply with our behaviour guidelines may result service refusal without the right of refund or compensation. Please report any misconduct by contacting clientcare@pliabl.co.

5          Terms of Service

Pliabl provides Performance Massage and recovery services. The use of our services is subject to the terms and conditions outlined here.

5.1          Appointments

Before booking an appointment, we encourage all clients to read our FAQ. This provides all information and details on what to expect before, during and after your appointments. Appointments may be available as individual appointments, bundles, or as memberships. See section 6 Payment and Billings for our Payment and Billing Policy.

5.2         Cancellation Policy

In the interest of providing a quality service for all our clients we operate a strict cancellation policy.  Please read our Cancellation Policy here. The Cancellation Policy should be read and understood prior to booking appointments or group classes.

5.3         Right of Refusal

Pliabl reserves the right to refuse treatment or attendance if the client is under the influence of alcohol or illegal substances, or if the trainer/therapist otherwise deem it unsafe for the client to attend. Pliabl also reserves the right to refuse treatment if the trainer/therapist deem the environment unsafe for the trainer/therapist. In the case of appointment refusal, you will be charged in full. For Pliabl membership clients, a session will be removed from your monthly subscription, the same applies for bundle sessions. If the environment is deemed unsafe, Pliabl reserves the right to refuse future visits at the same location, and reserves the right to book any further appointments at a clinic.

5.5        Chaperone Policy

Should you require a chaperone, you are welcome to have a family member or friend accompany you. For vulnerable clients or clients under the age of 18 we require you to bring a chaperone. Please make any chaperone preferences known prior to your appointment.

6          Payment and Billing Terms

6.1         Accepted Payment Methods

We accept all major Debit and Credit cards through our online booking system. Memberships are billed monthly by Direct Debit through GoCardless. In-person card payments is available at events and pop-ups only. Pliabl is a cashless business.

6.2         Card Details

Card details for all clients are taken at time of booking in line with our Cancellation Policy. Card details are stored securely in line with Data & Privacy Policy.

6.2          Payments Terms for Individual Appointments

For bookings of single individual appointments, a £50 deposit is required at the time of booking, with the remainder to be charged directly after your appointment.

6.3          Payments Terms for Packages and Bundles

All treatment packages and bundles are paid in advance with a 10% discount, or can be split in 3 interest-free payments. Packages and bundles are valid for 12 months from the date of purchase. They are non-transferable and non-refundable, and cannot be exchanged for a different product or service.

6.4         Payment Terms for Memberships

Pliabl memberships are billed monthly via Direct Debit through GoCardless. Direct Debit payments can only be made from a UK bank account. The minimum membership term is 3 months and will continue on a monthly rolling basis once the minimum term has expired.

If any monthly fees or charges incurred are not paid within 30 days after they are due, your membership may be terminated, and Pliabl may pursue any rights it has to recover the unpaid amount by referring any missed payments to a debt collection agency, where additional fees may be incurred.

Upon termination of membership, no refund of any associated fees will be issued.

Additional Terms & Conditions apply in accordance with the Membership Agreement.

7          Website & Social Media usage

This section outlines the usage terms and conditions for websites owned and operated by Pliabl and its associated official social media accounts.

7.1         Information on the Website and official Pliabl Social Media Accounts

Whilst we make every effort to ensure that the information on our website and our official social media accounts is as accurate and up-to-date as possible, you acknowledge and agree that we do not (to the maximum extent permitted by law) guarantee that:

a) the website or social media accounts will be free from errors or defects.
b) the website or social media accounts will be always accessible.
c) messages sent through the website or social media will be delivered promptly, or at all.
d) information you receive or supply through the Website will be secure or confidential.
e) any information provided through the website is accurate or true.

This website and our social media accounts may contain links to other third-party websites that are not owned or operated by Pliabl. We have no control or responsibility over the content of such third party linked websites or services, and we strongly advise you to read and understand the terms and conditions and policies of any third-party services that you visit.

We reserve the right to change and update any information or functionality on the website at any time without notice, including functionality, product descriptions, prices, and other website content.

7.2         Limitation of Liability

We make no warranties or representations about our website or any of its content and in no event shall Pliabl be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of this website or our social media accounts. To the maximum extent permitted by applicable law, we exclude any liability to you or any third party that may arise due to your use of our website and social media accounts, and/or the information or materials contained on it. By using our website and/or social media accounts you agree to indemnify us for any loss or liability arising out of your use of these platforms.

7.3         Intellectual Property

All content and materials available on our website or through any of our other online profiles/accounts, including but not limited to text, graphics, logos, images, and software, are the property of Pliabl Ltd and are protected by copyright, trademark, and other intellectual property laws.

7.4         Security

Pliabl does not accept responsibility for any loss or damage to computer systems, mobile phones or other electronic devices arising in connection with use of the website or our official social media channels. You should take your own precautions to ensure that the process that you employ for accessing the website or social media does not expose you to risk of viruses, malicious computer code or other forms of interference.

7.5          Data & Privacy Policy

Your use of our services is also governed by our Data & Privacy Policy and our Website Cookie Policy. By using our website and our services, you consent to the terms of our Cookie Policy and our Data & Privacy Policy.

7.6         Third-party user accounts

To access certain features of our services, you may be required to create a user account through a third-party technology service provider such as our booking system. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Whilst we take all necessary steps to ensure your data is being kept secure, we cannot make any guarantees on behalf of any third party-providers, and Pliabl cannot be made liable for any data breaches at a third-party website, application, or service.

8          Termination

We reserve the right to terminate or suspend your account and cancel any future appointments or services at our sole discretion, without notice, for any reason, including but not limited to a violation of these Terms and Conditions.

9       Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England & Wales. Each party irrevocably submits to the exclusive jurisdiction of the courts of England and Wales.
